Terms and Conditions

1. Scope

These Terms and Conditions apply to all orders placed by consumers (§ 13 German Civil Code, BGB) through my Shopify online store. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or self-employed professional activity.

2. Contracting Party

The purchase contract is concluded with:

3. Conclusion of the Contract

By listing products in the online store, I make a binding offer to conclude a contract for these items.
The contract is concluded when the customer accepts the offer by clicking the order button (“Buy now”). Immediately after placing the order, the customer receives confirmation by email.

4. Prices and Shipping Costs

All prices are final prices in euros and include statutory VAT.
Shipping costs may be charged in addition to the stated prices and are shown during the ordering process.
For deliveries to countries outside the EU, additional customs duties, taxes, and fees may apply and are payable by the buyer.

5. Delivery

Delivery is available within Germany and to the countries listed in the store.
Delivery generally takes 5–10 business days after receipt of payment.
For freight shipments (for example, large formats), the delivery date is arranged individually.

6. Payment Terms

The payment methods displayed in the store are available (for example, Shopify Payments, PayPal, credit card, or advance payment).
The invoice amount is due immediately.

7. Retention of Title

The goods remain my property until payment has been made in full.

8. Right of Withdrawal

Consumers have a 14-day right of withdrawal.
Detailed withdrawal instructions and a model withdrawal form can be found [insert here, e.g. separate page or section].

Exception: The right of withdrawal does not apply to individually commissioned artworks made to customer specifications.

9. Warranty

Statutory liability for defects applies.
Because my works are handmade unique pieces, minor variations in color, structure, and material do not constitute a defect but are part of the artistic character.

10. Liability

I am liable without limitation for claims arising from damage caused by me, my legal representatives, or agents

• in the event of injury to life, body, or health,
• in the event of intentional or grossly negligent breach of duty,
• in the event of guarantees, where agreed,
• where the German Product Liability Act applies.

In the event of a slightly negligent breach of essential contractual obligations, liability is limited to foreseeable damage typical for the contract.

11. Applicable Law

The law of the Federal Republic of Germany applies.
For consumers whose habitual residence is in the EU, mandatory consumer-protection provisions of their country of residence remain applicable.

12. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr.
I am neither obligated nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.
